QwikLocker Terms of Service & User Agreement

1. Eligibility & Age Restriction

You must be at least eighteen (18) years of age and legally capable of entering into binding contracts to register for an account or use QwikLocker hardware.

2. Subscription Billing & Fees ($6.99 / 30 Days)

• Continuous Subscription: The base QwikLocker membership is billed automatically at $6.99 USD every thirty (30) days.
• Included Delivery Credit: Each 30-day billing cycle includes one (1) delivery credit valid for one (1) reserved smart locker compartment.
• Cancellation: You may cancel anytime via Settings > Cancel Subscription or at https://qwiklocker.com/support. Cancellation takes effect at the end of the paid billing cycle.
• Non-Refundable: All past and current subscription charges are non-refundable.

3. Pre-Authorization & Additional Compartment Charges ($3.99 Overage)

• Any deliveries requested beyond your active included credit are billed at $3.99 USD per compartment.
• Multi-Package Pre-Authorization: If a carrier delivers multiple separate parcels that require more than one locker compartment, you expressly pre-authorize TQG, Inc. to charge your payment method on file an additional $3.99 per additional compartment used.

4. Dynamic Capacity & No Guaranteed Reservation

Locker compartment availability fluctuates continuously in real time. TQG does not guarantee that a specific locker tower or compartment size will be vacant at any given moment. Users are required to view the interactive map prior to checkout to verify local availability.

5. Carrier Agency & Delivery Fulfillment

You authorize third-party logistics carriers (USPS, FedEx, UPS, Amazon, regional couriers) and TQG delivery personnel to transport, scan, and deposit parcels into designated locker compartments on your behalf. Delivery is deemed legally completed and custody transferred upon the carrier depositing the parcel and closing the latch.

6. Prohibited Items

The following items are strictly prohibited:

• Hazardous materials, flammable liquids, explosives, or fireworks (DOT HAZMAT).
• Firearms, ammunition, or illegal weapons.
• Illicit narcotics or controlled substances.
• Live animals, biological matter, or perishable foods requiring refrigeration.
• Stolen goods or items exceeding compartment weight/size limits.

Violations result in immediate termination, forfeiture of goods, and referral to law enforcement.

7. Package Retention & Abandoned Property

Packages must be retrieved within 72 hours of delivery notification. Items remaining past seven (7) consecutive days without written arrangement may be deemed abandoned and subject to transfer, administrative storage fees ($5.00/day), or disposal after 30 days pursuant to California property statutes.

8. Limitation of Liability

All services and hardware are provided "AS IS". To the maximum extent permitted by law, TQG, Inc. and its hardware partners shall not be liable for courier delays, parcel theft, weather damage, power outages, or indirect damages. Total aggregate liability is capped at the greater of $100 USD or the subscription fees paid by you in the preceding three (3) months. California residents expressly waive California Civil Code § 1542.

9. Dispute Resolution & Mandatory Arbitration

Any disputes shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) in Santa Clara County, California. You waive any right to bring or participate in class action or representative proceedings.
